Both is intended. Floating windows get the freedom they request.
Otherwise fullscreen windows would be obscured by the bar. It's
all related to simplicity.
A third case is with bar toggling in floating mode - there is no
cool solution, so if it annoys you, don't toggle the bar at all,
or make it a bottom bar.
